The Colorado Workers Compensation laws allow an injured worker
to recover for his or her work-related injury regardless of
who was at fault in causing the injury or accident.

This means that the availability of Workers Compensation
benefits depends on whether the injured person was hurt while performing
the duties of the job. If someone has been injured at work, he may
be entitled to compensation for a portion of lost or reduced wages
and any approved medical expenses related to the injury. The benefits
are paid by the employer’s Workers Compensation insurance
company. The amount of compensation depends on the employee’s
average weekly wage at the time of the injury, the type of injury,
the degree of disability and ability to return to work, and whether
the disability is permanent.
Some work-related injuries arise from specific accidents (often
referred to as “industrial accidents”), such as a fall
from a ladder or scaffold, a machine accident or a motor vehicle
accident while driving the company vehicle. Other injuries, sometimes
called “industrial diseases” may occur more gradually
due to continued activities causing repetitive stress injuries,
such as carpal tunnel syndrome from operating machinery. If an injury
is covered under the Workers Compensation system, any additional
injuries that arise out of the work-related injury will generally
also be covered, including chronic pain syndrome or complications
from work-related surgery.
